PREAMBLE

These general terms and conditions of sale are agreed between the company Eponi, based at 87 rue du Fontenoy, 59100 Roubaix, France, hereafter referred to as ‘Eponi’, on one hand, and persons wishing to make a purchase via the website www.eponi.co, hereafter referred to as the ‘Customer’, on the other hand.

The terms and conditions of sale set out below apply to all orders placed with Sloli for all items and services offered on the www.eponi.co website unless otherwise agreed in writing in advance. You will be asked to read these Terms and Conditions of Sale when you place your order.

Consequently, placing an order implies your full and unreserved acceptance of these conditions.

Eponi reserves the right to modify certain provisions of its general terms and conditions of sale. The sales contract is subject to the French law.

OUR PRODUCTS

The www.eponi.co website presents and sells personalised books in which your child can be the hero.

Eponi takes great care in writing descriptions of its products, which are illustrated by one or more images or photographs. The photographs, texts, graphics, and all information and characteristics illustrating or accompanying the products are not contractual.

In addition, colours and patterns may vary. Eponi cannot be held responsible in the event of non-conformity between the photograph of the product and the product received.

THE PRICES

The guaranteed prices are those displayed on the website at the time the order is placed. However, they may be modified at any time in the event of special conditions linked, for example, to certain economic factors, changes in duties and taxes, or changes in the cost of labour or raw materials.

All prices are indicated in euros and include all French taxes.

The prices stated on the Customer’s order after validation and registration are final and fixed. In the event that the prices decrease some time after the order has been placed, Eponi will not be able to compensate the Customer for the difference. On the other hand, if prices increase, Eponi undertakes to deliver at the price applicable on the day of the order.

In the case of export sales, customs clearance and the payment of various duties or taxes are the Customer’s responsibility.

SHIPPING COSTS

For Metropolitan France, it costs 3 euros and is free for orders over 40 euros.

ORDERING

All orders imply full acceptance of the prices, product descriptions, and these general terms and conditions of sale.

The Customer must enter the information required to invoice the products at the time of ordering. The information provided at this time is binding on the Customer.

Once the details have been validated, the Customer chooses the payment method. The order will then be automatically validated and will constitute an irrevocable commitment that cannot be called into question, except in the cases exhaustively provided for in these general terms and conditions.

All orders are considered binding and may only be canceled with the consent of Eponi and on terms that will compensate Eponi for any loss or damage caused by such cancellation.

Once the order has been confirmed, the Customer will receive an order confirmation by e-mail, provided that the e-mail address given in the registration form is correct. This e-mail is an acknowledgment of receipt of the order and contains all the elements of the contract between Eponi and the Customer.

Eponi has the right to refuse or cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, as well as the right not to confirm an order for any reason whatsoever. Eponi has 5 working days to inform the Customer that the order cannot be fulfilled and ask the Customer to modify or cancel the order.

PAYMENT

Payment of the full price is due when the order is placed. Payment can only be made by credit card.

Payment is made immediately upon placing the order using a credit card (Mastercard, Visa, CB).

The customer is then asked to enter their bank card number, the expiration date, and the visual cryptogram shown on the back of the card.

The www.eponi.co website is protected by an SSL encryption system.

If the bank refuses to authorise the payment, the order will be canceled. In the event of an incident occurring at the time the order is placed, it will be canceled and the customer will have to repeat the order procedure.

To prevent fraud, Eponi may request additional proof from the customer when accepting the order.

BILLING

From the moment the payment for an order is received, a bill is available in the customer account accessible on the website www.eponi.co. For ecological reasons, Eponi does not send paper bills.

PRODUCT RETRACTION, RETURNS AND EXCHANGES

Eponi personalised books are produced on demand according to the customer’s wishes. By current regulations, Eponi does not accept requests for refunds due to changes of mind regarding the purchase or the personalised item. In these cases, the customer cannot exercise the right of return.

If the customer wishes to return an item due to an error made by Eponi, the customer must inform Eponi by email and Eponi will inform the customer of the procedure to follow.

Except in the case of a legitimate reason, any complaint made after fourteen (14) days following receipt of the products by the Customer will be considered inadmissible and Eponi will not be held liable.

CLAIMS AND LITIGATION

Any complaints should be sent by e-mail to contact@eponi.fr or by post to Eponi – 87 rue du Fontenoy – 59100 Roubaix.

An amicable solution will be sought before any legal action is taken. In the absence of an amicable solution, any legal action will be brought before the competent courts, notwithstanding the plurality of defendants or the introduction of third parties.

PERSONAL DATA

Eponi reserves the right to collect data about the user of the site by using cookies to track the user’s browsing on the www.eponi.co website.

A few days after each order is placed on its website, Eponi will send an e-mail to the customer inviting them to give their opinion on the product(s) they have received. These opinions are collected via an independent platform and enable Eponi to improve its offer and future customers to obtain additional information about the products. This feedback will only be sent once per order.

In accordance with Article 34 of the French Data Protection Act of 6 January 1978, Eponi guarantees the Customer the right to object to, access and rectify any personal data. The Customer may exercise this right via his Customer Account or by contacting Eponi by e-mail at contact@eponi.fr or by postal mail at the following address: Eponi – 87 rue du Fontenoy – 59100 Roubaix – France.

The Customer has the right to request Eponi to correct, update, or delete personal information that the Customer has provided on the site and has authorised to be stored in Eponi’s customer database. The Customer agrees to provide Eponi with true and accurate information.

INTELLECTUAL PROPERTY

All content on the www.eponi.co website is the exclusive property of Eponi. Any total or partial reproduction of this content is strictly prohibited.

Under no circumstances may the Customer download or modify all or part of the www.eponi.co website, in particular its content (products, descriptions, photographs, images, videos, etc.).

The www.eponi.co website or any part of it may not be reproduced, copied, sold, or exploited for commercial purposes without the express written permission of Eponi.

RESPONSIBILITY AND FORCE MAJEURE

The products presented and for sale on the www.eponi.co website comply with current French or European legislation and the standards applicable in France or within the European Union. Eponi cannot be held responsible for damages of any nature that may result from the improper use of the products sold to the Customer.

In any event, Eponi’s liability shall be limited to the amount of the order.

Eponi will not be held accountable for the total or partial non-fulfillment of its obligations if this non-fulfillment is due to an event constituting force majeure as defined by French case law, for example in the event of disruption or total or partial strike in particular of the postal services, means of transport and/or communication, flooding or fire. Nor can Eponi be held liable for any inconvenience or damage associated with the use of the Internet, such as a break in service or the presence of computer viruses or external intrusions.
